SHORT-TERM RENTAL USAGE AGREEMENT

This Short-Term Rental Agreement (the "Agreement") is made by and between the property management company ("The Host") and the Guest ("Guest"). By booking and staying at any of The Host’s properties, the Guest agrees to the terms outlined in this Agreement.

  1. Rental Unit: The rental unit is provided by The Host for temporary accommodation.
  2. Ownership: The Rental Unit is owned by an independent third party (the "Owner") for which The Host acts as an agent.
  3. Rental Party: The Guest is responsible for all individuals in their rental party.
  4. Maximum Occupancy: The maximum number of guests allowed per unit is strictly enforced.
  5. Visitors: Only registered guests are permitted in the Rental Unit. Anyone else the Guest allows in the Rental Unit (a "Visitor") is the sole responsibility of the Guest and is strictly forbidden unless approved by The Host.
  6. Rental Period: Check-in is at 4:00 PM, and check-out is at 11:00 AM.
  7. Late Checkout Fee: Guests must vacate by the designated checkout time.
  8. Unauthorized late checkouts will incur fees of $100 per hour. After 3:00 PM, an additional full-night charge up to $1,500 will apply, and the guest must still vacate the unit.
  9. Minimum Stay: A minimum stay may be required and will be specified at booking.
  10. Rental Rules: At all times throughout the Rental Period, the Guest shall and shall cause the Rental Party and any Visitors to abide by the rental rules attached as Exhibit A ("the Rental Rules").
  11. Access: The Host may access the unit for repairs, inspections, or emergencies.
  12. Damage: Guest shall report any damage or issues with the Rental Unit to The Host upon arrival or occurrence. Guest shall be responsible for any damage to or loss from the Rental Unit that occurs during the Rental Period, however, caused.
  13. Security Deposit: At the discretion of The Host, a security deposit may be required on or before the Check-In Date. Where applicable, such deposit is for security purposes and shall be refunded within 14 days of the Checkout Date provided no deductions are made due to: damage to the Rental Unit or contents thereof; debris or other mess requiring excessive cleaning; or any additional cost incurred by the host as a result of the Guest's stay.
  14. Cancellation Policy: Unless otherwise specified during booking, if the Guest wishes to cancel his/her reservation, payment will be refunded as follows: 7 (Seven days prior to arrival date with a refund minus first night room and state tax and if booked at a non-refundable rate no refund for any reason 100% will be charged and non refunded).
  15. Indemnification and Assumption of Risk: The Guest expressly assumes the risk of harm to themselves, their property, the Rental Party, and any Visitors arising from their use of the Rental Unit and the Common Areas. Guest shall indemnify and hold harmless The Host, the Owner, and any of The Hosts's affiliates, employees, agents, representatives, sub-contractors, successors, or assigns from and against any liabilities or any loss or damage whatsoever arising from, related to, or in connection with the Guest's use of the Rental Unit and/or Common Spaces, including, but not limited to, any claim for liability for personal injury or damage or loss of property which is made, incurred or sustained by the Guest, Rental Party, or any Visitors to the Rental Unit during the Rental Period.
  16. Governing Law: This Agreement shall be governed by and interpreted in accordance with local laws of Miami-Dade and the state of Florida.
  17. Payment: Payments must be made through the original booking channel or directly with The Host. Credit card usage may require additional verification.

EXHIBIT A: RENTAL RULES

  1. Maintain the Rental Unit in a clean and tidy condition.
  2. Smoking of any kind is prohibited. A $500 penalty applies for violations.
  3. Noise disturbances and nuisances are strictly prohibited.
  4. Unauthorized pets are not allowed. A $1,000 fee applies to violations.
  5. Do not move or rearrange furniture or appliances.
  6. Comply with all applicable laws.
    Leave the Rental Unit in the same condition as check-in.
  7. Security cameras are in common areas; noise and smoke detection devices are in the units.
  8. Quiet hours are from 10:00 PM to 7:00 AM.
  9. Charges apply for soiled or stained linens and towels.
  10. Only toilet paper should be flushed. The Guest is responsible for plumbing issues caused by improper disposal.
  11. Luggage storage is not available before check-in or after check-out.
  12. Daily housekeeping is not provided. Additional cleaning services are available for a fee.
  13. Any damages must be reported immediately.
  14. Maximum occupancy is strictly enforced. Unauthorized guests may result in eviction without a refund.
  15. Keys and access cards must be returned.
  16. Lost items will incur replacement fees.
  17. Shared amenities must be used responsibly.
  18. Trash must be disposed of in designated areas.
  19. Parties, gatherings, and illegal activities are strictly prohibited.
  20. Responsible Wi-Fi usage is required.
  21. Illegal activities or excessive data usage are prohibited.
  22. Tampering with smoke detectors, fire extinguishers, or safety equipment is prohibited.
  23. Guest information must be provided.
    The primary guest must be at least 25 years old and provide valid photo identification.
  24. No eating or drinking in bedrooms.
  25. Electric bicycles and scooters are not allowed on the property.
  26. The Host is not responsible for lost or stolen property.
  27. The Host does not handle mail or package deliveries.

By booking and staying at any of The Host’s properties, the Guest acknowledges and agrees to these terms and conditions.
